Bkuik – Customers - Terms and Conditions

1. Background and definitions.

This Web Site (hereinafter referred to as the Site, or the Portal), belongs to Bkuik s.r.l., Fiscal Code and VAT Number 09273100967, REA Number: MI – 208011, registered address in Milan, via Emilio Morosini 36 and operational headquarters in Milan, via Caldera 21, p.e.c. bkuik@pec.it- e-mail info@bkuik.com (hereinafter referred to as Bkuik or the Company). The Site is available to all users (hereinafter referred to as the Customers, or the Customer). When the Customer carries on a purchase on the Site or uses it otherwise, declares having read, understood and accepted these Terms and Conditions.

2. Scope of our service.

The Site is a telematics platform that allows the Customer to book ski lessons on-line offered by the ski instructors of the schools associated with Bkuik applying at the terms and conditions of the specific school published on the site of the school itself.
With the reservation the Customer establishes a direct relationship with the School to which belongs the chosen instructor (hereinafter referred to as the School).
The activity of Bkuik simply consists in making available to the Customer its own telematics platform and services to allow him performing comfortably and safely his on-line reservation of the chosen lesson and take care of the related fulfillments, among which sending to the Customer, on behalf of the School, an email to confirm the reservation with the receipt of the payment to the School, as well as collect the incoming payment, on behalf of the School, of the amount paid by the Customer.
The information available on the Site are published by the School, that is the only responsible for their truthfulness, completeness, correctness, and update.
The Service offered to the Customer by Bkuik is fully free of charge, not foreseeing any debiting or additional cost in comparison with the cost of the booked lesson, with the exception of the cost for opening the procedure for modifying, cancelling, and reimbursing the reservation as hereafter indicated in the art. 5. It is for personal use and not commercial and is carried out with respect of the rules on privacy protection.

3. Access and registration.

The access to the Portal of Bkuik is free. To book and use the related services the Customer must register itself on the Site, filling the registration form with its own personal data, and in a full way.
The Customer, at registration, acknowledges and bestows to Bkuik the full right to keep all the information provided, among which its own personal data and the information related to the payment methods.
Bkuik commits itself to keep confidential the information and the data provided by the Customer, with respect of the rules on privacy protection and treats them according to such regulation.
The data of the Customer will not be communicated or transmitted to third parties without prior beforehand authorization, except for the case in which it is required by the law or specifically foreseen in these Terms and Conditions. In order to keep the integrity of the Site, Bkuik reserves itself the right to forward the data of the Customer to supervisory authorities, including the police forces, when and where required. Likewise the data of the Customer can be communicated if an issue arises related to the use of the Site performed by the Customer, that is inconsistent with these Terms and Conditions.

4. Payment of the reservation.

The payment of the lessons is debited to the Customer when the lessons are booked and is exclusively performed through the credit or debit card of the Customer. The payment is not managed by the Site itself, but through a secure acquiring system adopted by the Site, supplied by one of the main worldwide acquiring providers, to which the Customer will be automatically redirected.
Following the payment the Customer will receive by Bkuik, that on behalf of the School manages the operational aspects, a receipt as acknowledgment of the performed payment directly issued by the School.

5. Cancellation of the reservation.

The Customer can request, directly from the Site, the cancellation of the reservation entering a requisition of reimbursement that is automatically sent to Bkuik. Bkuik, on behalf of the School, manages the request of change, cancellation, and reimbursement (total or partial) of the reservation executed according to the conditions made available among the information published on the Site from the School.
For the opening of the procedure for modification, cancellation, and reimbursement, Bkuik has the right to apply to the Customer the cost for handling the practice, equal to € 2 plus any statutory taxes.

6. Responsibility.

Bkuik can be hold responsible for direct and immediate damages effectively incurred by the Customer, that are directly related to a deficiency of its obligations in performing the Service. The indemnity will be able to reach the total amount of the cost of the reservation, as stated in the confirmation e-mail (or for a single occurrence or for a set of linked occurrences).

7. Intellectual property rights.

The telematics platform made available by Bkuik and the copyright of the contents (including the copyright), information and materials available on the Site are property of Bkuik S.r.l., of its suppliers and providers.

8. Obligations, rights, and powers of Bkuik.

Bkuik will accomplish any reasonable effort to keep the Site operational, functioning, and error free. If rarely the Site will not be accessible Bkuik will not be responsible for any damage, contractual and tort, arising from the activation, from the usage and/or from the interruption of the functioning of the Site.
Bkuik has the right, at any time, to suspend the services for needed maintenance or other technical reasons, and to refuse the access to its own portal to avoid possible damages.
Bkuik exclusively retains ownership of all intellectual and industrial rights on its brand, look and feel, layout and graphics of this portal (including buttons, icons, forms, logos), on any other distinctive sign, as well as on any content available on its own portal (such as videos, audios, images, texts).

9. Obligations of the customer.

The Customer commits itself not to use the Site and provided services in an incorrect way or liable to cause interruptions, damages, deterioration, or perform a reduction of the their efficiency.

10. Force majeure.

The Company will not be responsible for the failures to the Contract due to reasons of force majeure, related to circumstances that lie outside its sphere of control, such as, as an example and not exhaustive, exceptional events, natural calamities, risks of navigation, fires, explosions, drought, sabotages, accidents of any kind, embargoes, failures to telecommunication and infrastructure services, riots, and civil wars.

11. Applicable law.

The relationships between Bkuik and the Customer are governed by the Italian laws. For any dispute related to the interpretation and execution of this Contract will be competent the jurisdiction of Milan, with the exceptions of mandatory territorial jurisdiction, determined on the base of the residence or domicile of the Customer, if located on the Italian territory.
The original Italian version of these Terms and Conditions may have been translated into other languages. The translated version is a courtesy and office translation only and parties cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these Terms and Conditions or inconsistency or discrepancy between the Italian version and any other language version of these Terms and Conditions, the Italian language version to the extent permitted by law shall apply, prevail, and be conclusive. The Italian version is available on our website (by selecting the Italian language) or shall be sent to the Customer upon your written request.

12. Communications.

The communications to Bkuik can be sent through the Site, to the mail of the company or to the following address shown in the Contract, at which Bkuik appoints its domicile: Bkuik Srl - Via Caldera 21, Milano.

13. Privacy

To enter a reservation the Customer must provide his name and his e-mail address, as well as all needed data to execute the payment through credit card. It could be also asked his address and phone number. Such data are treated, both from Bkuik and the School, to the only end of a correct and complete reservation of the lessons through the site Bkuik.
To such aim is necessary that the Customer releases his own consent to the treatment of his own not sensible data, clicking in favour of both Bkuik and the School.
